Procedure to draft a civil suit:

IDFC Ltd. A Company duly registered under Companies Act, 2013 having its Registered office at Clock Tower, Dehradun through its director Mr. Sohan Kumar Aged about 32 years S/O Mr. Ramesh Kumar, R/O Dehradun, O/A Indira Nagar, Dehradun.

SUIT FOR COMPENSATION OF DEATH CAUSED BY ACCIDENT UNDER INDIAN FATAL ACCIDENTS ACT, 1955

THE PLAINTIFF MOST RESPECTFULLY SHOWETH:-

  1. That the Plaintiff is a housewife of Mr. Arun Singh R/o Prem Nagar, Dehradun.
  2. That the husband of the plaintiff was working in IDFC Ltd. Dehradun as an Assistant Engineer (T-5) in the grade of Rs. 25000/- per month.
  3. That defendant 1 is working as a security guard in the same company.
  4. That on 06/01/2022 at about 10:50 AM Mr. Arun Singh was attending to his official duties at the Indira Nagar, Dehradun Branch office premises.
  5. That Defendant 1 has left the gun loaded in the premises, omitting the duty to handle it. Some other workers in belief that gun is unloaded fired at Mr. Arun Singh.
  6. That Mr. Arun Singh was caused with grievous injury due to such action.
  7. That Mr. Arun Singh died in the district hospital, Dehradun on 06/01/2022.
  8. That the plaintiff and her in-laws are left behind having solemnly dependent on her late husband.
  9. That the husband of Plaintiff died due to the negligence of Defendant 1 in aforesaid manner.
  10. That the defendant was an employee of IDFC Ltd. and the negligence was caused during the employment hours.
  11. That the Plaintiff is legitimate wife solemnized under HMA, 1955 on 15/12/2018.
  12. That the Plaintiff is entitled to compensation of ₹2,00,00,000 (Two Crore Rupees only) for maintenance.
  13. That compensation is necessary for the maintenance of three people namely the plaintiff and her in-laws.
  14. That the Valuation of the Suit for the purpose of Court fee and Jurisdiction is Rs. 20,000 and Court fee of Rs. 500 has been affixed.
  15. That having regard to the claim of the Plaintiff and the cause of action having arisen in the area of Dehradun this Hon’ble Court has jurisdiction to entertain and try this Suit.
  16. In the facts and circumstances of the case mentioned hereinabove this Hon’ble Court may graciously be pleased to:

PRAYER

That the Plaintiff, therefore, pray that this Hon’ble Court may pass –

  1. A decree for recovery of Rs. 2,00,00,000 in favor of the Plaintiff and against the Defendant No 1, Defendant No. 2 with interest @ 10% per annum from the date of accident upto the filing of this suit, and 7% per annum, from the date of decision till realization till decree amount.
  • The Plaintiff be paid their cost from the defendants.
  • Any other relief, which the Hon’ble court deems fit, may please be granted to the plaintiff in the interest of justice.
