Supreme Court: Ordinary Matrimonial Discord Alone Cannot Establish Abetment of Suicide

Introduction

The Supreme Court has reiterated that the existence of matrimonial discord cannot, by itself, establish the offence of abetment of suicide. In Sanjay Kumar v. State of Himachal Pradesh, 2026 INSC 948, the Court set aside the conviction of a husband under Sections 498-A and 306 of the Indian Penal Code, 1860, finding that the prosecution evidence did not establish the necessary ingredients of cruelty or abetment. The case arose from the suicide of the appellant’s wife.

Abetment Requires More Than a Troubled Marriage

Section 306 IPC criminalises abetment of suicide. Section 107 IPC explains the circumstances constituting abetment. The Supreme Court examined whether the evidence demonstrated the necessary element of active instigation or intentional conduct connecting the accused to the suicide.

The Court found that the prosecution witnesses had made general allegations of harassment but had not established specific incidents sufficient to prove the charge. The Court also noticed material omissions between the statements of witnesses and their evidence before the court.

Criminal Liability Cannot Be Based on General Allegations

The judgment reinforces an important principle in criminal law. The fact that a marriage was troubled, or that the deceased was unhappy in the matrimonial home, does not automatically establish that the accused abetted the suicide. The prosecution must prove the statutory ingredients beyond reasonable doubt. The Court consequently restored the trial court’s acquittal.

Conclusion

Matrimonial disputes frequently involve allegations of cruelty and harassment. But criminal liability under Section 306 IPC requires proof going beyond the existence of marital discord. The judgment therefore reinforces the distinction between a difficult matrimonial relationship and legally established abetment of suicide.
