Section 15. Act of Judge when acting judicially.—

Nothing is an offence which is done by a Judge when acting judicially in the exercise of any power which is, or which in good faith he believes to be, given to him by law.

Comments

Judge is defined under Section 2(16) of BNS, 2023. It means a person who is officially designated as a Judge. The judge must be able to give a definitive judgment whether it can be appealed or not. The protection given to judges under section 15 is to ensure the proper functioning of the judiciary and prevent malicious prosecution against those involved in the legal process.  

Corresponding Section

Section 15 of BNS, 2023 corresponds to Section 77 of IPC, 1860.
